4 CBD Products to Take on Your Next Flight

Maybe you heard the news that broke over Memorial Day weekend: The Transportation Security Administration (TSA) announced that it would allow certain CBD products through its security screenings. But don’t rejoice just yet—there are stipulations to this new rule.

Here’s the official blurb from the TSA’s website:

“Marijuana and certain cannabis infused products, including some cannabidiol (CBD) oil, remain illegal under federal law except for products that contain no more than 0.3 percent THC on a dry weight basis or that are approved by FDA. (See the Agriculture Improvement Act of 2018, Pub. L. 115-334.)”

The announcement only covers hemp-derived CBD products that contain less than 0.3% tetrahydrocannabinol (THC) or drugs approved by the FDA (read: Epidiolex). So, if you’ve got a high-CBD tincture with an 8:1 CBD-to-THC ratio, you could still technically be busted for that.

And of course, all marijuana products remain illegal at the federal level. So if you’re caught with them at a checkpoint, TSA is required to report it.

But the question remains: If you have a high-CBD product that contains more than 0.3% THC, other than looking at the label, how are TSA officers supposed to know? And what’s to stop a person from taking a product whose labeling states that it has less than 0.3% THC and replacing the contents with a product that’s high in THC?

The reality is that there isn’t a way to know without testing the actual product—and we all know that TSA doesn’t have time for that. On its website, TSA states that its main objective is security, not the enforcement of drug laws. But its agents are still required to alert authorities if they find federally prohibited materials in your luggage.

If you take CBD to manage a certain condition and don’t want to get held up at a security checkpoint because you have CBD products on you, the best course of action is to make sure that your products are compliant with TSA rules. In other words, you’re transporting items that are 0.3% THC or less—even if there’s technically no way to be sure that CBD products are what they say they are without testing.
